Hey Guys.. I'm not sure how many of you subscribe to Napster's newsletter, but here is what was in my mail today and I thought I might share it with you guys.............................................. ..........
The Ninth Circuit Court of Appeals has ruled against Napster in our
effort to keep the major recording companies from shutting us down.
We are not shut down, but under this decision we could be. We are
very disappointed in this ruling by the three-judge panel and will
seek appellate review. The Court today ruled on the basis of what
it recognized was an incomplete record before it. We look forward
to getting more facts into the record. While we respect the Court's
decision, we believe, contrary to the Court's ruling today, that
Napster users are not copyright infringers. We will pursue every
avenue in the courts and the Congress to keep Napster operating.

It's just a great opportunity to hear an old song that you may have forgotten about.. or to check out new music that you may like to buy... for me.. its a way to keep the 80s alive in my house... Well, I for one never really use Napster, since I dont have a computer at home I only use the one here at work. However, If I did have one at home, I would definately want to use the service. However there are several alternatives to Napster that I have heard about, two are mojonation.com and audiognome.com
I am not sure if they are as usefull as Napster, so I will not make comment about them.
I feel that it is WRONG for somebody to download a CD before it is even released. However for some songs that are out of print, I think this is a valuable source. Why should music become "extinct" because a record company exec decides it wont sell anymore.
I know my brother in law has made custom CDs to listen to in his truck, he is a truck driver, so taking a bunch of CDs out with him is not feasable. So he will look for songs that will keep his interest that he doesnt already have on CD, and load them. He doesnt sell them, and only uses them for his own use. I think this is a valid reason to be able to participate in file sharing.
I just wish Lars and Co could remember back in 1984/5 when they were NOBODIES and the majority of the nation who DID know them, knew them from bootlegs of thier EP and their live shows. The same thing applies here. SHARING MUSIC makes bands more popular. Most bands make cash off of the TOURS, not the CDs. So, if 1000 people have the CD, and they share the CD with 2 people each. That is 3000 people who may want to see them when they come to town. That makes more financial sense to me.
But then again, I am just a comsumer, why should my opinion count for anything?

morningmyst 2-13-01, 05:46 PM I, too, use Napster...and, I've also checked out other mp3 sites. None of them have the easibility of Napster. I use it to check out a song on certain cd's...if I like it, I go and buy the cd. There's nothing worse than buying a cd where you totally dislike all of the songs. I also use it to bring back memories from 80's songs that I can't find anymore.
Anyways, that's why I use Napster.

I use it for exactly the same reason, Morningmyst..... there may be a 70s or 80s song that just popped into my mind.. and you know.. I just really feel like hearing that song right now! It's not very feasible to just run out and get the cd.. its nice to be able to choose what you want to listen to and when... unlike the radio, where you have to wait for that favorite song to come on... (which in most of our cases.. since we are 80s freaks, that is not possible)... Most Napster users do not SELL what they download... (in fact.. I am probably sure very few of them do) and I agree, Jasper that sharing songs CAN be very beneficial to the artist's popularity thus making them more money on merchandise and tours. It's also great for new artists to promote their music as well.. bands like "Livesay" can distribute their music to many fans that way, too.
I have tried some of the other file sharing and searching methods... Napster has over 60 million users... so finding that obscure song is not a challenge.. you know that one of those users has it.
It's just so widely used that it IS by far, the best and it will be a shame to do away with it.. http://www.80sxchange.com/ubb/smilies//frown.gif

No idea where I'd be without Napster. Nor mum! I don't get new songs, only old ones which I can't find on cd especially if they're from groups/artists who only had a couple of hits. Most songs I can only find on Napster anyway. None of the others have much in the way of old stuff. But hey, where there's a will there's a way! I read earlier today that Napster has offered a couple of deals (including millions of dollars) that have so far been rejected. The latest offer is to charge a small fee to users and to create some way of keeping users from being able to copy the songs they download using a cd burner. They are waiting for an answer from the people suing them on this latest offer.
So, who would pay for the Napster service? I have never checked out any other mp3 downloading sites. But, judging what some of you have said I don't want to. So, yes, I would pay, as long as it is a 'small' fee.

I was tempted to try BearShare myself till I found out it drops hidden files on your system (called spyware). These files transmit your web activity back to companies to monitor your surfing activities. They then sell the info to other companies who are popular for spamming. Unistalling Bearshare doesn't take these files off either and manually removing them messes up your web settings and causes IE to quit working. The only way to fix it is to resore your registry from a uninfected copy or reinstalling windows. I don't mean to scare anybody but I'm very against "spyware" and feel it should be made illegal unless you're informed before you install the program that it contains "spyware". Other alternatives to Napster are newsgroups. They have an 80's music newsgroup even! There's also Cute FTP and personal FTP servers. Check out audiogalaxy.com if you want to find FTP servers with lots of music. There are thousands of em out there. The downfall to FTP servers is that most people require a ratio. ie. you send me one mp3 and you can download 2....stuff like that.
Hopefully Napster will work something out because it is the easiest way to find your fave obscure 80's tune!
Ok.. so the ruling now is that Napster has to pull all copyrighted songs so that they cannot be shared.. which basicaly leaves nothing for us to download...
Here's the headlines...
Napster, the wildly-popular song-swap software, said on Tuesday it would comply with U.S. District Court Judge Marilyn Hall Patel's injunction, ordering it to remove songs from its directory three days after it is notified by their copyright owners.
The labels are required to provide lists of the material they want removed. "As we receive notice from copyright holders as required by the Court, we will take every step within the limits of our system to exclude their copyrighted material from being shared," he said.

tigerladydeb 3-09-01, 02:04 PM I will miss napster. I compiled a cd of a local mn band that sort of made it big and I don't know where else I could have gotten the songs. It is out of print and without the access on napster this band and these songs will never again be heard by new fans.
Sorry, but Metallica has sold out. This is just my opinon. Many bands will not have any new exposure without places like napster to revive them.

Are you sure it is shutting down, Daw.. I heard that the record companies are just going to pull selected copyrighted material.. and they have to compile lists... I may be wrong... but that's what the enws was a few days ago..
I will miss Napster as well.. I have downloaded just about everything I am going to at this point though... I have been stockpiling mp3s ever since the debate started so that I would be prepared for a shut down..
There's still time to do that guys... just in case!!

But the reason I am posting this.. is a new one was released today touching on the subject of Metallica and other copyrighted members being pulled from Napster's database... and it is pretty ,uch telling you to just change the name of your mp3s slightly so that they can still be searchable... (not a bad idea)

Looks very silmilar to Napster.. but there has to be lots and lots of users (like Napster has) to find alot of the obscure stuff ... plus.. they have this disclaimer...

Please do not infringe on the copyright of other people! We are in negotiations with copyright organisations in order to reach an agreement where you can use the KaZaA service for a low fee. You will be able to enjoy the works of your favourite artists, who will receive their well-earned royalties.
Sounds just like they are going through the similar battle that Napster is.. and you will probably have to pay to use it as well...
I'm going to stick it through with Napster until the very end... and then... I will try some of the others... but with over 60 million member's to share with.. Napster is still the way...

New Napster news straight from the guys at Napster...
As you probably know by now, the federal district court has issued a pre-trial injunction ordering Napster to block the sharing of specific music files at the request of copyright holders (in most cases, record companies or music publishers). We understand that this injunction has created some confusion, and we'd like to explain what's going on as best we can.
First, Napster is and will continue to be up and running. The injunction doesn't shut Napster down; instead, it requires us to work with the recording industry to block the sharing of specific, copyrighted works after we receive notice that those works are
available through Napster. And remember - this is just a preliminary injunction. There will still be a trial, and our appeals are pending. It's not over by a long shot.
We're complying with the injunction even as we pursue our case in court. At the same time, we're trying to reach a business settlement with Vivendi/Universal, AOL/TimeWarner, Sony, EMI, and the music publishers. We've already received some removal notices, and we
expect the record and music publishing companies to send many more. However, you'll still be able to share music that those companies haven't blocked. We're doing everything we can to preserve the Napster Community and the file-sharing experience.
Second, we want to thank you again for your tremendous support. Even as we comply with the injunction, we find it hard to understand why the recording industry continues this attack on their best customers - the people who use Napster. Check out the top-selling CDs this week: the number one album on the Billboard chart is Everyday by the Dave Matthews Band. Three weeks before the album's release, its debut single, "I Did It," was featured on Napster at the band's request. In the number two spot is Shaggy, who saw his sales climb
because a DJ in Hawaii discovered "It Wasn't Me" using Napster. No wonder we believe Napster helps record sales.
As you know, millions of people sample new music using Napster, then go out and buy that music. In addition, millions of people discover new artists through Napster. People who use Napster buy more than three times as much music on average as non-Napster users. Members of the Napster Community are music's most passionate fans. Found a decent online alternative to Napster. It is called eMP3Finder. It's kind of like Yahoo for MP3's. If you can't find it on Napster, you may want to give it a try. Here is the url: http://www.emp3finder.com/

I was trying to find a Wall of Voodoo song the other night.. and the only things that came up were "VooDoo Wall" So.. people ARE finding ways to get around this... its so easy!!!
