C'mon people. If you go to a rock concert expect a little "volume". What would've happened to this chick had she gone to a Nugent or Metallica concert back in their heydey?


German Promoter Ordered to Pay Over Hearing Loss

HAMBURG (Billboard) - A German concert promoter has been ordered to pay $5,300 for "pain and suffering" to a woman who alleges that her hearing was damaged during a Bon Jovi concert four years ago.

The firm, Marek Lieberberg Konzertagentur (MLK), must also cover the costs of the 38-year-old woman's medical treatment and loss of income, a regional court in Nuremberg ordered Tuesday.

The court upheld the plaintiff's claims that MLK did not take sufficient precautions to limit the volume of the open-air concert, which took place in Nuremberg in September 2000. The plaintiff stood about 3-5 meters from a speaker, and now claims to suffer from tinnitus, a form of permanent hearing damage.

The court heard that Bon Jovi's sound technician was left to determine the volume levels for the concert. However, "given his position as the cause of the noise, he was objectively not suitable for ensuring compliance with general standards of safety," the court said.

MLK founder Marek Lieberberg said the ruling was "very dubious." He told Billboard that the decision was "a perfect scenario for anyone who wants to pretend that they have sustained harm in an attempt to sue for compensation for pain and suffering." Lieberberg has yet to appeal the decision.

I agree with you, KimJoy. You stand that close to the speaker and it is going to be a bit loud.

I lost a little bit of hearing in one ear (not much, but I notice it sometimes) at a Dio show a few years ago. I don't think it's Dio's fault that I was standing in the first row of a Heavy Metal concert with no ear plugs. I also think it was my own responsibility when I injured my ribs at a Slayer show - I could have moved when everyone in the hall decided that they wanted to stand where I was standing :D Everyone knows there's always a little risk of hearing loss or other kinds of injuries when you're at a concert. I you don't want to take that risk, you shouldn't be there.

Haha! Spooky, I know what you mean! I was front row RIGHT in front of the speakers at a Def Leppard concert in 2003. My ears were ringing the next morning (I was right in front of Vivian....did the whole hand grab thing) but I sure as hell aint gonna sue them! No one MADE me stand there! The venue provided me ear plugs...what more could they have done?

Ridiculous!

Oh pu-leaseee..no they did not..lol..c'mon people..you know I agree..no one made em stand there..but hey if you wanna be that close tyo the band, atleast have sense enough to wear EARPLUGS!!! Believe me, you can definately still hear the band(as I know all of you concert goers know..)

There are a lot louder concerts than Bon Jovi - although standing that close to a speaker...OF COURSE it's gonna be loud! Use earplugs if you can't take the noise! :rolleyes:

Its just par for the course..if u can go to a concert like that, and get a chance to stand next to the output that close, u do it. now not necessarily for a long time..but.. :lol: still, how can u possibly even attempt a lawsuit like this..but then again, if u can sue mcdonalds for coffee thats too hot, why not!! :dammit:

Damn - if I'd not bothered to wear earplugs to all those concerts ( especially AC/DC in 1988 ), I'd be rich right about now...

And I've screwed my ears anyhow, with too many years of loud headphones.

I agree. This is a sue happy world. Never mind what it does to the band, the promoters and every one else. Btw, I love New York too.
